Terms of Service

The agreement
These terms are between you and Marcelo AI Inc, of Los Angeles, California, and reachable at support@meetmarcelo.ai. By creating an account or using the service you accept them. If you are accepting on behalf of a company, you confirm you are authorised to do so.
What Marcelo does
Marcelo helps marketing agencies plan, draft and publish marketing work for the businesses they represent. It analyses websites, drafts text, generates images and video, and — once a person approves — publishes to platforms you have connected.
Nothing is published without a person approving it. That is a design rule of the product, not a setting. Generation produces work that waits for review; a human decision moves it any further.
Your account
Keep your credentials secure and tell us promptly if you think someone else has access. You are responsible for what happens under your account, including anything done by people you invite to it.
You must be at least 18 and able to enter a contract.
Your content, and the accounts you connect
You keep ownership of everything you upload — photographs, business details, text. You grant us the licence needed to store it, process it and pass it to the providers listed in our privacy policy so the service can function. That licence ends when you delete the content.
You confirm that:
- you have the rights to the material you upload, including any photograph showing a person or a property;
- you are authorised to act for every business you add, and to connect the accounts you connect;
- the facts you enter about a business are true.
That last one matters more here than in most products. Marcelo states only what you have confirmed, so a wrong fact becomes a wrong claim published under your client's name.
Websites you build from a site you like
Marcelo can build your website by following the arrangement of another site you point it at. When it does, we keep that layout — how many pages there are, what order the sections come in, the spacing and the colours — as a template in our own library, and we may offer that template to other Marcelo customers.
A template holds the shape and nothing else. It carries no photographs, no wording and no business details — not from the site you pointed at, and not from yours. Your website, its pictures and its words stay yours, and nothing here gives anyone a licence to them.
Building from a site you like is what puts a layout in the library; a site Marcelo designs for you from scratch does not. There is no separate payment either way.
AI-generated output
Text, images and video produced by Marcelo are generated by AI models. Subject to your having paid any fees due, you own the output and may use it commercially.
But review it before it goes out. AI models can produce text that is wrong, and images that do not depict reality. Marcelo is built to reduce this — generation is restricted to facts you have confirmed, and unknown facts are marked as unknown rather than filled in — yet no such system is perfect. You are responsible for what you publish.
Similar output may be generated for other customers. We do not promise that output is unique.
Acceptable use
Do not use Marcelo to:
- publish anything unlawful, deceptive, defamatory or infringing;
- make claims a business cannot support — including licences it does not hold, certifications it has not earned, or results it cannot deliver;
- impersonate a person or a business, or misrepresent who you are;
- publish to accounts or websites you are not authorised to publish to;
- attempt to breach the service, work around its limits, or resell access to it without our agreement.
Regulated trades carry their own advertising rules. Following them is your responsibility, and Marcelo does not check compliance for you.
Fees
Where a paid plan applies, prices, billing period and included usage are shown before you subscribe. Fees are charged in advance and are not refundable except where the law requires it. Usage beyond an included allowance may be charged separately, and is shown in the app as it accrues.
We may change prices with 30 days' notice by email. If you do not accept a change, cancel before it takes effect.
Third-party services
Marcelo connects to services run by other companies — Google, WordPress, social platforms and others. Your use of those services is governed by their terms, not ours. We are not responsible when a third-party service changes its rules, restricts an account, or goes down, and such an event does not entitle you to a refund.
Availability
We aim to keep the service running but do not promise it will be uninterrupted or error-free. We may change or discontinue features. If we discontinue the service entirely, we will give you at least 30 days to export your data.
Ending it
You can stop using Marcelo and close your account at any time. We may suspend or close an account that breaches these terms, or that puts the service or other customers at risk. Where circumstances allow, we will warn you first.
Liability
To the extent the law allows, Marcelo is provided as-is, without warranties of any kind. We are not liable for indirect or consequential loss, lost profits, or lost data. Our total liability for any claim is limited to the fees you paid us in the twelve months before the claim arose.
Nothing here excludes liability that cannot legally be excluded.
Indemnity
You will cover us against claims arising from content you published through Marcelo, from your use of an account you were not authorised to use, or from your breach of these terms.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Los Angeles County, California, and both sides consent to their jurisdiction.
Changes
We may update these terms. If a change materially affects you we will email you before it takes effect, and continuing to use the service after that means you accept it.
