Copyright & DMCA Policy

Marcelo AI Inc respects the intellectual property of others and expects the businesses that use Marcelo to do the same. This page explains how to tell us about content you believe infringes your copyright — whether it appears in the Marcelo application or on a website Marcelo hosts for one of its customers — and what happens next.

Sending a notice of infringement

If you believe your copyrighted work has been copied in a way that constitutes infringement and is accessible through Marcelo, send a notice to our designated agent containing all of the following, as the Digital Millennium Copyright Act requires:

  1. your physical or electronic signature, or that of a person authorised to act for you;
  2. identification of the copyrighted work you claim has been infringed;
  3. the address of the material you claim is infringing, precise enough for us to find it — the full URL of the page, and where the page carries several pictures, which one;
  4. your name, postal address, telephone number and email address;
  5. a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law;
  6. a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.

A notice that does not contain all six may not be effective. Knowingly misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. §512(f).

Designated agent

Notices go to:

Copyright Agent
Marcelo AI Inc
4654 Columbus Ave, Sherman Oaks, CA 91403
support@meetmarcelo.ai

Put “DMCA notice” in the subject line so it is handled promptly.

What we do with a notice

On receiving a complete notice we remove or disable access to the material identified, tell the customer whose account or website carried it, and give them a copy of the notice. Where the material is a photograph a customer uploaded, it is removed from every place Marcelo put it that we control. Where it is on a website Marcelo hosts, the page is taken down or the material removed.

We cannot remove material from a platform we do not host — a customer’s own WordPress site, a Facebook Page or a Google Business Profile listing — but we will stop Marcelo publishing the material there and will tell the customer to remove it.

Counter-notice

If you are a Marcelo customer and believe material was removed by mistake or misidentification, you may send our agent a counter-notice containing: your physical or electronic signature; identification of the material and where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, for Los Angeles County, California) and that you will accept service of process from the person who sent the original notice.

We forward a complete counter-notice to the person who sent the notice. If they do not tell us within 10 business days that they have filed a court action, we may restore the material within 10 to 14 business days after receiving the counter-notice.

Repeat infringers

We close the account of a customer who is the subject of repeated, valid notices of infringement, and take down the websites Marcelo hosts for them, in accordance with our Acceptable Use Policy.

Trademarks and other rights

A complaint about a trademark, a right of publicity, or any other right that is not copyright can be sent to the same address, with the same detail about where the material is and what right it infringes. We handle those under our Acceptable Use Policy rather than under the DMCA procedure above.
